Terms & Conditions

These Terms and Conditions ("Terms") govern your use of the services provided by Varsity Points Inc. d/b/a ASM Sports ("ASM Sports," "Company," "we," "us," or "our"), including our college recruiting representation, sports management, commercial representation, and related programs (collectively, the "Services").

By engaging our Services, signing an enrollment agreement, or making any payment, you ("Client," "Athlete," "you") acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not engage or continue to use our Services.

To enable us to perform our Services effectively, the Client must maintain a complete and up-to-date profile and provide all information, documentation, and materials we reasonably request. This includes accurate academic records, athletic history, highlight footage, personal details, and any other information relevant to the Client’s recruitment or representation.

Our ability to secure connections, placements, and opportunities depends directly on the completeness and accuracy of the information the Client provides. We are not responsible for delays, missed opportunities, or unsuccessful outcomes resulting from incomplete, inaccurate, or withheld information.

General Rule. All fees paid to ASM Sports are non-refundable, except as expressly set out in this Section 3. No refund will be issued where the Client changes their mind, elects not to proceed, or decides not to come to the United States for any reason.

College Recruiting — Standard Program. For our standard college recruiting program, fees are non-refundable once the enrollment agreement is signed and payment is processed.

College Recruiting — Premium and VIP Program. Where the Client has enrolled in our Premium or VIP program and paid the applicable fee in full, the Client is eligible for a refund if ASM Sports is unable to secure any college connection for the Client — meaning at least one direct conversation between the Client and a college coach facilitated or arranged by ASM Sports.

Once ASM Sports has secured at least one such college connection (a direct conversation with a coach), no refund is due, regardless of the ultimate outcome of that connection or any subsequent recruitment decision.

No refund is available where the Client’s failure to secure a connection or placement results from the Client’s incomplete profile, failure to provide requested information, failure to respond to communications, or failure to participate in the recruitment process in good faith.

ASM Sports does not guarantee admission, scholarship, roster placement, or recruitment at any specific college, university, or institution. All admissions and roster decisions are made solely by the respective institutions and their coaching staff.

Once the Client is in the United States, ASM Sports is not responsible for the decisions of any coach, institution, or athletic department, including decisions regarding playing time, scholarship renewal, roster status, or admission.

Clients enrolled in our VIP program receive ongoing support while in the United States. ASM Sports will, to the best of our ability, assist and support the Client during their time in America, including guidance with transfers and related matters.

This support is provided on a best-efforts basis and does not constitute a guarantee of any transfer, placement, or specific outcome. The Client remains responsible for meeting all academic, athletic, and eligibility requirements of their institution and any applicable athletic association.

We may update these Terms from time to time. Changes become effective immediately upon posting. Continued use of our Services after any change constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the courts located in Palm Beach County, Florida.
